The sponsor of the Contest is Bettertheworld Inc. (the "Contest Sponsor" or "Better The World").
1. CONTEST PERIOD
28 Days for Haiti (the "Contest") commences 12:01 AM EST on February 1, 2010 and ends 11:59 PM EST on February 28, 2010 (the "Contest Period"). This Contest is brought to you by Better The World Inc. (the "Contest Sponsor").
2. ELIGIBILITY
No purchase is necessary.
Completion of http://www.bettertheworld.com (the "Contest Website") on-line member registration form is required to be eligible to enter the Contest. The Contest Sponsor reserves the right to disqualify any participant who violates the registration restrictions.
Each person is limited to one membership registration. Points gained through duplicate or invalid email accounts will not be considered.
The Contest is open to members of Better The World who are legal residents of Canada, the United States or the United Kingdom. Complete information including parent or guardian permission to play the game must be provided upon entry for all participants under 14 years of age during the time of the Contest. Any false representation, erroneous information or violation of these rules and regulations or the general objectives of the Contest will result in the disqualification of the participant. Contest is applicable to federal, state, provincial, and local laws and is void where prohibited.
Better The World, its employees, the members of their immediate family, their agents or representatives are not eligible to enter the Contest.
3. HOW TO ENTER
Once you are registered, you will be presented with a series of actions for earning points. As you complete the tasks successfully, you will earn points. Points will be updated several times during a day and verified once per day by 6am EST for cumulative activities up to the previous day.
Visit http://www.bettertheworld.com and register as a member to start earning points. Visit http://www.bettertheworld.com/top-supporters (the "Top Supporters" webpage) during the Contest Period to stay up to date on point leaders.
By entering this Contest, you agree to be bound by these rules and the decisions of the Contest Sponsors.
4. PRIZES AND DRAWS
An award of $1 will be made for every new valid member that registers at bettertheworld.com during the Contest Period. In order to qualify as a valid member, each new member must validate their account. $1 donations will be made on behalf of all valid and eligible contest participants up to a cumulative, aggregated maximum total amount of $500.
GENERAL
5. Before being declared a winner of a prize, the selected participant(s) (or his parent or legal guardian for the participants under 18 years) must correctly answer, unaided, a mathematical skill-testing question, confirm compliance with the rules and regulations, and complete, sign and return by the required date, a declaration and release form (and any other documents, as applicable).
In the event the selected participant is under 18 years of age, the participant's parent or legal guardian may accept the prize on behalf of the child.
6. Prize(s) will be awarded upon receipt of the declaration and release form and verification of prize winner(s). The Member of the Month prize may be forfeited if a selected participant cannot be reached by the date(s) specified above; is not in compliance with these contest rules; incorrectly answers the skill-testing question; declines the prize(s); fails to return the declaration and release form (and any other documents, as applicable) by the date set out in the documents; or if email correspondence between the Contest Sponsor and selected participant is returned as undeliverable without a forwarding address. If a prize is forfeited, the Contest Sponsor may randomly select another participant from the remaining eligible entries.
7. The decisions of the Contest Sponsors are final and participants agree to abide by all of the instructions and decisions of the contest judges. In the event of any dispute regarding the interpretation of these official contest rules, the decision or interpretation of the Contest Sponsors shall prevail.
8. Any participants registration in the Contest that is, incomplete, altered, or contains false information, is invalid. Contest Sponsor is not responsible for lost, stolen, delayed, damaged or misdirected claims or entries during the Contest Period. The Contest Sponsor is not responsible for any errors or omissions with respect to the printing or advertising of this Contest and reserves the right to withdraw or cancel this Contest in the event of a printing or administrative error.
9. None of the Contest Entities (defined below) accepts any responsibility for loss, damage or claims caused by the awarded prizes or the Contest itself. By entering, participants release, indemnify, and hold harmless the Contest Sponsor, and its affiliated and related companies, the prize suppliers, retail partners and the Contest Sponsor's advertising agencies, promotional agencies, charity partners, and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the "Contest Entities") from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any prize won.
10. For greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by Contest Website users or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in operation of the Contest Website or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer online systems, servers or providers, computer equipment, software, or failure of email which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to participants' or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Contest Entities which corrupt or affect the administration, security or proper conduct of this Contest, the Contest Sponsor reserves the right at its sole discretion to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way.
11. In the event of a dispute as to who is the online participant registered in the Contest, the participant will be deemed to be the authorized account holder of the email address submitted at the time of registration. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Selected participants may be required to provide the Contest Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.
12. The Contest Sponsor reserves the right at its sole discretion to disqualify any individual from the Contest, and to ban that individual from any future promotion of the Contest Sponsor, if the Contest Sponsor finds or believes such individual to be tampering with the registration process or the operation of the Contest or where applicable, the Contest Website; to be acting in violation of the Contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass the Contest Sponsor, the Contest Sponsor's agencies, other participants or any other person. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR(S) RESERVES THE RIGHT TO REPORT ANY SUCH VIOLATION TO THE APPLICABLE AUTHORITIES AND TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
13. By entering this Contest, you consent to the Contest Sponsor's use, should you become a winner, of your name, city of residence, public member profile information, and photograph or other likeness, without further compensation or notice, for publicity, advertising or informational purposes in any media or format (including the Internet) in connection with this Contest or future similar contests.
14. The Contest Sponsor will collect personal data about the participants for the sole purpose of administering this Contest. The Contest Sponsor respects your right to privacy. Please review the Contest Sponsor's privacy policy at http://www.bettertheworld.com/privacy for details on the manner in which we collect, use, disclose, and otherwise manage your personal information.
15. This Contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario. Any dispute or claim made by a party shall be filed in the judicial district of Toronto, Ontario to the exclusion of any other jurisdiction.
16. Right to Terminate, Modify or Suspend: The Contest Sponsor may at any time, at its sole discretion and without liability, terminate, modify or suspend the Contest in whole or in part, subject only to the approval of any applicable regulatory authority, if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Official Contest Rules and Regulations. Without restricting the generality of the foregoing, and subject to the permission of the Régie, in the event of early termination of the Contest, a notice will be posted on the Contest Website.
17. Contest Sponsor reserves the right at its absolute discretion to vary, delete, or add to any of these Official Contest Rules and Regulations from time-to-time without prior notice. In the event of conflict, these Official Contest Rules and Regulations shall prevail over any of the contents of any other promotional materials advertising this Contest. Contest Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules and Regulations, or acts with intent to annoy, abuse, threaten or harass any other person.
18. Quebec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses, et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
19. Currency: All currency indicated in these Contest Rules and Regulations is in Canadian dollars.
